Michele Sherman Davenport represents foreign exporters and United States importers of products and services subject to regulation by the U.S. Government. Such regulation generally takes the form of unfair trade cases (antidumping and countervailing duties and "Section 301"), "safeguard" investigations, and issues of Customs classification and value. Her practice combines intensive litigation with strategic planning for her clients on a wide variety of issues.
Michele is qualified to practice law as both a US lawyer and an English solicitor and has a personal rating of AV (very high to preeminent) from Martindale-Hubbell. She has defended a broad range of clients, from Canadian provincial governments to producers of agricultural products to integrated steel manufacturers, in numerous agency proceedings before the U.S. Department of Commerce, International Trade Administration, and the U.S. International Trade Commission. Michele has represented her clients in many of the largest and most complex investigations undertaken by these U.S. agencies.
A past president of the Association of Women in International Trade, Michele Sherman Davenport has over twenty years' experience in all aspects of countervailing and antidumping duty practice, including both investigations and administrative reviews. Michele also advises clients in connection with bilateral and multilateral trade agreements such as the North American Free Trade Agreement ("NAFTA") and the World Trade Organization ("WTO"). In this regard she often counsels clients concerning appeals taken by their governments to WTO dispute panels.
Michele has unparalleled experience in defending Canadian agricultural programs from subsidies challenges. Over more than two decades, she is unique in having participated in every U.S. countervail investigation involving Canadian agricultural commodities, including swine (1985 and 2003), pork (1989), cattle (1999), and wheat (2003).
Michele Sherman Davenport has particular expertise in the dispute settlement mechanisms established under the United States - Canada Free Trade Agreement and the NAFTA. She argued successfully for Canadian interests in the first U.S. trade case litigated before a Binational Panel established under the NAFTA, and appeared in half of all the U.S. trade cases litigated before Binational Panels established under the earlier United States - Canada Free Trade Agreement.
